متن قرارداد اقامت دائم* Service Agreement
between the Licensee [Morteza Homapour, RCIC #514558] and the Client(s)
This Agreement is made between:
* Morteza Homapour [“the Licensee”] from VisaMondial Consulting Ltd.
and
* [Client’s Name] and [Accompanying Family Members’ Names: Please include Spouse, and all accompanying Children] [“the Client(s)”].
The Licensee will represent the:
* Main Applicant [Client’s Name] to apply for permanent residency via UP TO ONE Federal and/or ONE Provincial pathway [“the Application”].
* Main Applicant’s Spouse [Spouse’s Name] to apply for permanent residency (If applicable).
and their accompanying child/children:
* [1st Child’s Name] for permanent residency (If applicable).
* [2nd Child’s Name] for permanent residency (If applicable).
The Licensee and the Clients agreed on the following terms:
1. Pre-conditions of this Agreement:
1.1. The clients must ensure all provided information is correct and complete. Otherwise, the licensee reserves the right to withdraw from the agreement within 5 business days of issuing a written notice. Any fees paid for services already provided will not be refunded.
1.2. The Client(s) understands and agrees with the following:
* Decisions on the Application will be made by immigration officials only, and the Licensee does not and cannot guarantee any specific result, but the licensee will advance the case diligently, to the best of his knowledge, and professionally based on the facts provided by the Clients, and the regulations announced by Immigration Authorities.
* The Licensee's employees, who are under the direct supervision of the Licensee, will maintain direct contact with the Client(s) throughout the duration of this contract. These employees are not authorized to provide legal or immigration advice, and only the Licensee is responsible for any advice given during the process.
* If Client needs a live conversation with the Licensee, Client can choose to request ONE live meeting with Licensee. This request should be in writing and Licensee should hold the meeting in 5 business days after the request is received. If additional meetings requested, the Applicant agrees to pay an additional fee of $200 CAD per hour for this service. This fee is not covered under this agreement and will be charged separately. The session can be arranged by the Licensee's employees, who must be contacted by the Client through a formal email. The Applicant may need to wait up to 5 business days for this session to be scheduled, and an additional 5 business days may be required before the session can be held.

The processing times listed on the Canada Immigration Official Website are approximate and subject to variability. Several external factors outside the Licensee's control may extend or shorten these times. The Licensee's employees will keep the Clients informed of any decisions or updates from the immigration authorities regarding their file. Clients will receive notifications from the Licensee's employees within 5 business days of any status change.
* Changes to immigration law, policies, and procedures can occur at any time without prior notice, potentially rendering the Application impossible or substantially more complex. These changes are beyond the control of the Licensee. If unexpected government actions significantly affect the Application, the Licensee reserves the right to terminate this Agreement and may propose negotiations for a new agreement (If applicable). Since this agreement is not contingent on the outcomes, all services rendered up to the point of termination remain payable, and any fees paid for which no service has been rendered will be refunded.
1.3. Should new facts arise that raise an admissibility issue or otherwise substantially impact the Application and the work required, the Licensee may terminate this Agreement and renegotiate a new Agreement with the Clients, if applicable. Additionally, in such cases, any fees for services already provided will still be payable. Moreover, any additional fees already paid for services not yet rendered may be considered for inclusion in the new agreement, if applicable.
2. Responsibilities of the Licensee:
2.1. The Licensee will provide the following list of Services for the Client(s) during the validity of this Agreement:
* Act as the contact address for immigration authorities on behalf of the Client.
* Prepare and submit a complete application.
* Provide guidance on the documentation necessary or helpful for the application. The Licensee may use or provide pre-recorded content to explain the required documents. The content and approach are determined by the Licensee.
* Provide detailed explanations to address any issues that arise in the file, as developed, and directed by the Licensee.
* Represent the Clients in interactions with immigration officials.
* Communicate with the Clients via the direct email address specified in this contract (director@visamondial.com), in the language requested by the Client (Farsi/English). Emails sent to director@visamondial.com are reviewed and responded to by the Licensee within 5 business days. All other communications are handled by the employees.
2.2. All information provided by the Clients to the Licensee may be used in the Application submission. The Clients are directly responsible for the accuracy and authenticity of any information or documentation provided. Any submission of false information or documentation is solely the responsibility of the Client and not the Licensee.
2.3. All information provided to the Licensee by the Clients is protected in accordance with the requirements set forth in the Code of Professional Conduct for Immigration Consultants. The Licensee will not release information provided by the Clients to any third parties without the Clients’ consent unless such disclosure is required by law.
2.4. The Licensee will respect the Clients' right to privacy and confidentiality, maintaining the confidentiality of all client information indefinitely, unless disclosure is required by law. Additionally, information may be disclosed to individuals whose names are listed in this contract, including spouses, as permitted under the agreement.
2.5. Confidentiality does not apply between the Clients whose names are included in this contract and the Licensee regarding any matters affecting the file.
2.6. Clients' paper records will be securely stored to maintain confidentiality and protect against damage or loss.
2.7. All reasonable measures will be implemented to secure electronic files, information, and documents to ensure their safety and integrity.
3. Clients’ Responsibilities:
3.1. It is the Clients’ responsibility to:
* Pay the installments as outlined in section 4 of this contract.
* Provide truthful information regarding their case.
* Provide all requested documentation in a timely manner.
* Provide a 4-months or a 6-months bank transaction history when submitting the application. This serves as proof of the clients’ financial statements to Immigration, Refugees and Citizenship Canada (IRCC).
* Provide any additional documents requested by immigration authorities to the Licensee by the deadlines specified.
* Notify the Licensee of any changes in their circumstances that may affect their immigration case.
* Authorize the Licensee as the primary contact with immigration officials and notify the Licensee of any direct communications received from immigration officials. If the Client links their account to any other account not authorized by the Licensee, the contract will be automatically terminated without any refund of fees.
3.2. The Clients are required to pay all expenses associated with the processing of their case. This includes, but is not limited to, office-related costs like photocopying and long-distance calls, government fees for filings and biometrics, international courier service fees, medical exams, police certificates, and translation of documents. These costs are the responsibility of the Clients and must be paid as they occur. The Licensee is not responsible for these expenses.
3.3. If the fees are not paid as stipulated in section 4 of this agreement, the Licensee may cease representation of the Clients 5 business days after issuing a written notice. Any fees already paid for services rendered will not be refunded, and any outstanding fees remain payable.
3.4. The Clients are required to maintain contact with the Licensee and respond to communications from the Licensee's within 5 business days. Failure to do so may result in the Licensee discontinuing representation of the Clients. In such cases, any fees paid for services rendered will not be refunded, and any outstanding fees remain payable.
3.5. The Clients must provide the Licensee with truthful and accurate information relevant to their case. This is crucial for the Licensee to effectively represent them and to meet ethical and professional standards. The Licensee is not liable for any advice given based on incorrect or misleading information provided by the Clients. Furthermore, the Licensee's obligations under this Agreement are nullified if the Clients knowingly provide any false, inaccurate, or misleading information. In such cases, any fees paid for services rendered up to the point of discovery will not be refunded, and any outstanding fees remain payable.
3.6. If the Licensee suspects that one or both Clients are not being truthful or are otherwise breaching their obligations under this Agreement, the Licensee will provide them with a reasonable opportunity to clarify and rectify the issue. This opportunity includes allowing the Clients up to five business days to respond with an explanation or corrective action to the Licensee’s satisfaction. Should the Clients fail to resolve the matter within this timeframe, the Licensee may terminate their representation. In such cases, any fees paid for services rendered will not be refunded.
4. Fees:
4.1. The total fee for this contract is $4,500 CAD for the Main Applicant and $1,000 CAD for the client’s spouse, if applicable.
4.2. Total payable (before Tax): (will be calculated in the final step of the form) $ CAD
4.3. Tax Clause: If the client signs this agreement while in Canada, the total payable amount will encompass the contract fee along with an applicable 5% tax. This tax represents the prevailing rate and encompasses the Goods and Services Tax (GST) as mandated by Canadian law.
4.4. The payment schedule is as follows:
* 30% is due upon signing this agreement.
Breakdown: case assessment, providing document checklist, assessing documents, navigating on potential immigration streams.
* 20% upon creating a profile on IRCC and PNP
Breakdown: creating express entry profiles on IRCC and PNP EIOs.
* 50% is due upon the submission of the application.
Breakdown: Prepare a case file and submit relevant immigration application/s, drafting a submission letter. Assist Client until the decision is made by the immigration authority.
5. Refund Policy:
5.1. The earned fees charged for the services provided within this agreement are not refundable.
5.2. The definition of earned fees in each step of the contract are as follows:
* before receiving the document checklist: 500 CAD.
* After the client receives the document checklist: 1500 CAD
* After documents are collected: all the payments received will be earned and thus non-refundable.
* In case of a visa refusal at any point, there would be no refund. The client will be assisted in hiring an immigration lawyer to apply for a JR at his/her cost.
5.3. The Client may cancel this Agreement at any time by sending a written notice to the Licensee at (customer.service@visamondial.com). In this case, no refunds will be issued for any fees already collected.
6. Legal provisions
6.1. The Client understands the Licensee is a Regulated Canadian Immigration Consultant, licensed by the College of Immigration and Citizenship Consultants [“the College”] under Registration #R514558, and not a barrister and solicitor or lawyer licensed by a law society.
6.2. The College is the licensing body for Canadian immigration consultants, setting standards and enforcing the Code of Professional Conduct:

6.3. Should any issues arise between the Clients and the Licensee, the Client must bring the matter to the Licensee’s attention in writing and by email only (director@VisaMondial.com) and wait for the response. Specific details, including the facts and reasons for concern, should be stated in the Client’s email, and this Paragraph should be cited to apprise the Licensee that it is a formal request to resolve an issue. A response will be provided to the Client in 5 business days, and the Licensee will attempt to resolve the matter in good faith.
6.4. Should the dispute not be resolved after a written request from the client to the licensee, the Client may access the complaints procedure of the College. The College may be contacted at 5500 North Service Road, Suite 1002 Burlington, ON L7L 6W6 or toll-free at 1-877-836-7543 or electronically through: https://college-ic.ca.
6.5. The College may require the production of documents in accordance with the College Act and its regulations and by-laws.
6.6. In the event a Client has reason to believe the Licensee may be deceased or incapacitated, the Client should contact the College at the above address.
6.7. This Agreement shall be governed by the laws in effect in the Province of British Columbia, and the federal laws of Canada as applicable. Any disputes with respect to the terms of this Agreement unless otherwise provided for in this Agreement, shall be decided by a court of competent jurisdiction within the Province of British Columbia.

Subject of the Agreement: Career coaching services within Canada.
Career coaching is an essential service that helps individuals navigate the complexities of career development, including job search strategies, networking, and interview preparation. Visa Mondial Ltd. is committed to assisting clients in achieving their professional goals by offering tailored job coaching services. Whether you are looking to improve your resume, sharpen your interview skills, or set career goals, Visa Mondial is here to guide you on your career journey.
Contract Amount:
1. Standard Package: 799 CAD, which includes career coaching services.
2. Prime Package: 2500 CAD, which includes advanced and tailored career coaching services.
3. Job Placement Success Fee: If the Company secures a job offer for the Client, the following additional fees apply based on the Client’s annual wage at the time of signing the employment contract:
• Annual wage between CAD 40,000 and CAD 60,000: Additional fee of CAD 2,000.
• Annual wage between CAD 60,000 and CAD 75,000: Additional fee of CAD 4,000.
• Annual wage between CAD 75,000 and CAD 90,000: Additional fee of CAD 5,000.
• Annual wage above CAD 90,000: Additional fee of CAD 6,500.
Service Terms and Conditions:
1. Dates and times of the sessions will be mutually agreed upon by both parties.
2. The client is required to attend all sessions. Any schedule changes must be communicated to the company at least 48 hours in advance. In the event of a missed session by the Client without providing at least 48 hours’ notice, the session may be forfeited.
Included Services:
Standard Package:
• One detailed assessment session (1 hour) to understand the Client’s career goals, strengths, weaknesses, and market position.
• One career Coaching session (45 minutes) focusing on defining a career roadmap, professional branding, and skill-building.
• Creation or revamp of 1 professionally written resume tailored to the Client’s target roles, compliant with Applicant Tracking System (ATS) standards.
• Enhance the Client’s LinkedIn profile to include a compelling headline, optimized keywords, and strategic network-building recommendations.
• Interview preparation, including two practice sessions and one mock interview session (60 minutes) with tailored feedback based on specific job roles.
Prime Package:
All services included in Standard Service plus the following:
• Targeted job applications will be submitted weekly based on the Client’s preferences and qualifications.
• The client will receive regular reports on application progress and feedback.
Cancellation and Refund Policy:
1. No refunds will be issued after the contract is signed for the Standard Package.
2. If no job offer is received within six months, 500 CAD of the Prime Package fee will be refunded to the client.
Consent to Use Personal Information:
The Client consents to the collection, use, and sharing of their personal information by the Company for delivering agreed services, including job applications and career coaching. The Client may withdraw consent at any time with written notice.
Educational Materials and Confidentiality:
1. All provided materials and educational content are the intellectual property of Visa Mondial Ltd. Sharing or distributing them to third parties is strictly prohibited.
2. The Client acknowledges that the services provided by the Service Provider are coaching, educational, and advisory in nature, designed to assist the Client in career development and job search strategies. These services do not guarantee job placement and employment. The success of the Client’s career development efforts depends on various factors, including their full participation and external circumstances.
Any disputes regarding the execution of this agreement will be resolved in accordance with Canadian laws.
